Hi there,
Help needed please.
Parking Charge Notice from Britannia Parking received. required to pay £100 (£60 if paid within 14 days)
Local pub with pay and display car park but customers are refunded the fee.
It was dark when the car park was entered and the driver didn't notice any signs (although they were not looking for any). The staff didn't mention the refund or even ask if the driver had used the car park.
Ignore, pay or appeal?
thanks in advance.

    Appeal.

Follow the guidance in post #1 of the NEWBIES thread.

Send the easily found there, already written for you, blue text template appeal.

Send it unchanged - no additions or alterations needed.

    Send it as the keeper.

At the same time complain to the pub.
Tell them that you, your friends, family and business colleagues will no longer be able to visit this establishment now that you have discovered that each visit comes with a £100 surcharge.
  • Thanks, I'll do that. I have just heard from my clients who also had no idea It was pay and display (although they have not had a letter yet)

You need to also edit your opening post to avoid clues to the driver's identity.

Here's how one sentence could be adjusted:
It was dark when the driver entered and didn't notice any signs (although he wasn't looking for any).
    Adjust other sentences similarly.

Also, please confirm that you are the registered keeper of the vehicle and that it is not a company car, leased or hired car.
A different path may be needed in those cases.

hundreds of pubs and gastro pubs and restaurants are this way nowadays

you put the VRM into an IPAD or similar to prove patronage of the pub or restaurant , its like that at THE BEACH at Holingworth Lake Ffor example , PAY IN THE CAR PARK , REFUND IN THE PUB AT THE BAR

its not like it used to be , these parking companies are everywhere, so always check for signs and if in doubt , ask

try to get the landowner to cancel it , even if it means complaining to their CEO

and as KeithP says above , learn legal speak

    THE DRIVER
    THE KEEPER

    etc

    not "MY , ME , MYSELF & I" ! , this isnt gcse english

    Hi there,
    Help needed please.
After visiting a local pub for a client meeting for less than an hour I received a Parking Charge Notice from Britannia Parking. required to pay £100 (£60 if paid within 14 days)
After some digging back at the pub it turns out it's a pay and display car park but customers of the pub are refunded the fee.
It was dark when I entered and didn't notice any signs (although I wasn't looking for any). The staff didn't mention the refund or even ask if I had used the car park.
    Ignore, pay or appeal?
    thanks in advance.

What does the landlord say ? is he in for a slice of the action ?
Does he warn the customers about this car park scammer ?
Does he not realise that Britannia could force him out of business
because of the scam ??? If this gets to social media and the press,
    his pub could be history

Get the landlord to get this cancelled
  • Thanks for replies. I am the registered keeper of the vehicle. Appeal sent via Britannia portal. Review left on trip advisor for offending public house. reading through the reviews it seems others have complained about similar situations and have not got anywhere with the management, being told "You should have bought a ticket. We've had angry customers before and we'll have more after you."

Get your own photos of the unlit signs in similar light conditions at the time of the 'contravention'.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The poorer the quality of the signs the better.

Don’t be shy - name the pub.
We can all visit trip advisor !!
  • The pub is The Tiger Moth in Rochester, Kent. I’ll go take some pics later tonight.

Took a look at Trip Advisor and saw that one angry parking-related review mentioned 'errors of judgement' on the part of the customer & you mention not looking for signs. It's human nature to want to be even-handed but there's nothing even in the relationship between the PPCs and motorists. Signs need to be in-your-face clear, especially in darkness which is prime pub time! And publicans should be motorist-friendly.

If the driver was a total fool, that's one thing. But 'inattention' when visiting a pub!? Don't mention it at all, it's not relevant and it must be kept out of appeals.
